1. PRELIMINARY

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Yasah Resorts Pvt Ltd, operating under the trade name PlanMyOuting, and any user accessing or availing booking services (“User”, “Customer”, “You”).

By accessing, browsing, or using this Website or making reservations through PlanMyOuting, you expressly agree to these Terms, our Privacy Policy, and all applicable laws of India including the Bharatiya Nyaya Sanhita (BNS) 2023, the Indian Contract Act 1872, the IT Act 2000, the Consumer Protection Act 2019, and other applicable regulations.

If you do not agree to these Terms, you must discontinue using the Website immediately.

2. SCOPE OF SERVICE

1. PlanMyOuting is an Online Travel Aggregator (OTA) only.
   The Company solely provides a booking facilitation platform for resorts, homestays, adventure parks, villas, campsites, and activity providers (“Service Providers”).

2. No Ownership or Management of Properties

   • We do not own, operate, manage, supervise, monitor, maintain, administer, or control any of the listed properties or services.

   • All properties are independent third-party operators.

3. Separate and Independent Entity

   • The Company acts strictly as an intermediary and nothing shall be construed as a partnership, joint venture, agency, employer-employee, franchisor-franchisee, or representative relationship.

4. No Operational Responsibility
   We do not participate in:

   • Property maintenance

   • Guest management

   • Safety protocols

   • Staff supervision

   • Security

   • Food & beverage

   • Adventure activity operation

   • Accident response

   • Legal compliance of Service Providers

5. Information Provided by Properties
   All descriptions, images, pricing, availability, amenities, and policies are provided by the respective Service Providers. PlanMyOuting does not verify, endorse, guarantee, or certify the accuracy of such information.

3. DISCLAIMER OF LIABILITY

By using this platform, you expressly acknowledge and agree that the Company:

3.1 No Liability for Accidents or Incidents

PlanMyOuting, its directors, employees, agents, affiliates, and representatives shall bear no liability for:

• Accidents, injuries, fractures, medical emergencies

• Deaths

• Property damage or theft

• Misconduct, harassment, or negligence by the Service Provider or its staff

• Food poisoning or hygiene issues

• Fire, electrical fault, equipment malfunction

• Wildlife encounters, natural calamities, floods, rain, storms

• Adventure activity risks such as ATV, zipline, rope courses, sky cycling, etc.

3.2 No Liability Under BNS or Civil Laws

The Company shall not be held liable under:

• Bharatiya Nyaya Sanhita (BNS) 2023

• Civil courts, consumer forums, or any quasi-judicial body

• Criminal liability, including Sections relating to negligence, endangerment, or public safety

• Torts, including negligence, breach of duty, or vicarious liability

All legal disputes arising from incidents at the property are solely between the Customer and the Service Provider.

3.3 No Representation of Customers

PlanMyOuting:

• Does not represent any Customer in disputes

• Does not attend police stations or legal proceedings on behalf of Customer or property

• Cannot be held accountable for behaviour of Customers or Service Providers

3.4 Force Majeure

The Company shall not be liable for circumstances beyond its control, including but not limited to:

• Natural disasters

• Political unrest

• Government restrictions

• Internet failures

• Technical issues

• Property closure

• Pandemic or epidemic restrictions

4. BOOKINGS, PAYMENTS, CANCELLATIONS

4.1 Booking Policies

• All bookings are subject to availability and Service Provider acceptance.

• Prices are dynamic and may change without prior notice.

4.2 Payment

• Payments made on the website are processed by third-party payment gateways.

• PlanMyOuting is not liable for:

  • Payment failures

  • Delays

  • Technical issues

  • Refund delays by the payment gateway

4.3 Cancellations & Refunds

• Each Service Provider has its own cancellation, refund, and rescheduling policy.

• PlanMyOuting does not guarantee refunds as properties may have strict or non-refundable policies.

4.4 Additional Charges

Customers may be charged by the Service Provider for:

• Early check-in/late check-out

• Extra amenities

• Damages

• Additional guests

• Activity access fees

5. CUSTOMER OBLIGATIONS

The Customer agrees to:

1. Provide accurate details while booking.

2. Follow all safety guidelines, instructions, and property rules.

3. Carry government-issued ID proof as per Indian laws and KYC norms.

4. Not engage in illegal activities such as:

   • Drug use

   • Violence

   • Property damage

   • Wildlife harm

   • Nuisance

   • Violation of local regulations

5. Ensure the safety of children, elders, and dependents.

6. Immediately notify the Service Provider of any emergency.

6. INDEMNITY

The Customer agrees to indemnify and hold harmless Yasah Resorts Pvt Ltd (PlanMyOuting) from any claims, losses, damages, liabilities, legal costs, injury claims, or third-party disputes arising from:

• Misconduct or behaviour of the Customer

• Disputes with the Service Provider

• Injury or death

• Illegal or negligent acts

• Violation of property rules

• Damage caused to property or equipment

This indemnification survives termination of booking.

7. INTELLECTUAL PROPERTY

All logos, brand names, designs, content, software, databases, and features belong to PlanMyOuting / Yasah Resorts Pvt Ltd.
Unauthorized copying, scraping, redistribution, or commercial use is strictly prohibited.

8. THIRD-PARTY LINKS

The website may contain external links for convenience.
We do not guarantee, endorse, or take responsibility for external content, safety, or accuracy.

9. TERMINATION

PlanMyOuting reserves the right to:

• Refuse service

• Cancel bookings

• Block access

• Modify or discontinue the website

without prior notice, especially in cases of fraud, misuse, or illegal activity.

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India, including:

• Bharatiya Nyaya Sanhita (BNS) 2023

• Indian Contract Act 1872

• Consumer Protection Act 2019

• Information Technology Act 2000

• Relevant State and Central laws

All disputes shall be subject exclusively to the courts and legal authorities in Bangalore, Karnataka.
